Abstract (EN)
This study, focusing on remote work within the context of the pandemic, consists of three main sections. In the first chapter, the concept of flexibility under the title of flexible employment relationships, flexibility in labor law, and the historical development of remote work after the Industrial Revolution and post-Covid-19 pandemic are discussed using national and international legal sources. The second chapter delves into the concept of remote work, establishment and elements of remote work contracts, various forms of remote work, the transition to remote work implementation, and its impact on working conditions. Finally, in the third chapter of this study, the individual labor law implications of remote work are explored, encompassing rights and obligations arising from remote work, the emergence of the right to disconnect as a new concept, the protection of the privacy of remote workers, and the examination of trade union rights such as the right to join a union, benefit from union activities, and the right to strike from the perspective of collective labor law. Furthermore, the employer's responsibilities arising from occupational health and safety in terms of social security law are discussed. Additionally, the section addresses distinct issues related to remote work contracts, such as the classification of remote work accidents and occupational diseases, as well as whether Covid-19 qualifies as an occupational disease for remote workers. Through identifying potential challenges that may arise in the implementation of this new organizational form, the study endeavors to propose recommendations to address these issues.
