Abstract (EN)
Nowadays, interest in the stock market is growing rapidly. In order to ensure the reliability of the capital market, this interest has also become an important issue in monitoring and controlling the market. Millions of new investors have joined the Turkish stock exchange in recent years. It can be said that new and inexperienced investors are more likely to be manipulated in this regard. The Capital Markets Law criminalizes practices that disrupt the market, such as insider trading, manipulation practices. In fact, preventing, detecting, banning and punishing these behaviors is critical to protect investors and increase market confidence. In other words, the positive perception of investors towards the market prevents the occurrence of crime in the capital markets by protecting investors. In our study, the offence of market fraud (manipulation), which prevents the effective and safe operation of the capital market, is examined. In this context, the capital market law in the United Kingdom, the United States of America and the European Union legislation within the scope of both Turkish Law legislation and international law is explained.
