Avrupa Birliği çevre politikası:Türk çevre mevzuatına uyumu

The purpose of this study is to determine Turkey?s current environmental conformity to the European Union?s acquis on the environment. Primarily the historical development of the subject of environment in the European Union, legal tools and administrative institutions in Turkey and European Union are investigated. In the acquis compliance section horizontal, water, nature protection, biodiversity, waste management, chemical products, genetically modified organisms, and noise management sectors are studied, furthermore, the estimated cost of ensuring compliance for each sector is specified. Ministry of Environment and Forest has targeted full compliance by 2010. However, the real difficult part is the ability to achieve full implementation. Consequently, the high cost of compliance, although mentioned frequently, is not the only difficulty that Turkey will face during this period. Inadequate administrative capacity, lack of trained personnel, and weak environmental conscious are other important difficulties facing Turkey. Also, the lack of preparations for seeking financing is among the difficulties Turkey will have to face. Therefore, as soon as possible an ?investment strategy? must be developed and within this framework plans how to create a fund (for which the estimates range from 35 to 70 Billion Euro) must be drawn. In order to comply with high cost directives, financial and implementation plans requested for derogation must be presented to the EU. Other important difficulties include ambiguity within the Turkish administration, unclear distribution of authority, and imprecise definition of delegated authority. Turkey has serious implementation difficulties. They are caused by insufficient personnel, having few educated personnel, and weak inspections coupled with low rates of collecting fines. Inadequate administrative and financial capacity naturally further complicates the implementation process. I ncomplete data and indeed lack of data complicate the analyses consequently limit the follow up processes. Successful conclusion of Turkey?s negotiations on environment depends her fixing the shortcomings mentioned above.
