Abstract (EN)
This study arising from the health service of management and exploring the liability for compensation consists of three parts. A health services conception and its types are specified in the first part. Along with that, the brief information about the staff and places where the services are provided is given in the following part.The features of the service defect in health services, situations provoking the service defect, conditions requiring responsibility of the management in this respect and causes removing and reducing this responsibility have been examined in detail in the second part. And besides, French and Turkish State Councils? views in respect of jurisdictional decisions about the following subject have been set forth.A compensation conception in compensation actions arising from the health services is specified in the third part. In addition to that, a manner of compensation action in administrative jurisdiction in the framework of jurisdictional decisions, and expert subject in defect determination procedure have been examined in the last part of the following study.
