Freedom of union and its protection

In the historical duration, from the ancient times to the daylight where the globalization process experiencing intensively human rights and freedoms are one of the most important concepts that engage the mind of humanity on the interdisciplinary scale. Human Rights are basically the result of an approach in which the individual is considered to be a front-line and accepted as not a rights object but a rights subject. The main purpose of this concept is to protect the individual who is relatively weak against the powerful structures like the state. In this framework the individual, will be free from his / her disadvantaged position thanks to his/ her own rights. Even though only the state exists as a powerful organization against the individual at the beginning of the human rights thinking, with all the branches of law started to be dealt with in the context of human rights, th econcept of the individual becomes specific and people and institutions that have more powerful positions than individuals began to confront the spesific individual. Honestly, if you handle the labor law in the context of human rights, the concept of the individual will become specific and transformed into worker and the employer will come out.In this context, the protection of workers who are in a weaker position than the employer will be necessary in terms of ensuring justice. The protection of the rights owned by the workers will be possible with the support of a strong organization to the workers. This powerful organization is the trade union. Thanks to their own organizational structures, trade unions have gained a strong and substantial especially in the collective bargaining agreement. This situation has led to confrontation with employers disadvantaged situation. On the basis of this, an organizational structure requirement was born in terms of employers. This requirement has been eliminated through the establishing of employers' unions. With the passage of time, the thinking of not only workers and employers but all the employees who have contributed to the production process with expending their effort, should benefit from union protection has been strengthened.
