Abstract (EN)
The Capital Markets Board ("Board") was established to carry out economic law enforcement activities in the capital markets. This activity is exercised by the Board in the form of making regulations in the capital markets, conducting surveillance and audit activities in the capital markets, and, when necessary, imposing administrative measures and administrative sanctions on relevant real and legal persons. Administrative measures and administrative sanctions, which impose more severe restrictions on the fundamental rights and freedoms of their recipients than the other law enforcement powers of the Board, must therefore be imposed with great care and diligence. In this study, the Board's administrative measures and administrative sanctions are analyzed in terms of the cause and subject matter elements of the administrative act, and the illegalities in the Board's administrative measures and administrative sanctions are revealed in terms of these elements.
