Resolution of corporate law disputes through arbitration

Arbitration has become a prominent method in dispute resolution with its benefits for both parties and countries. In Turkey, the arbitrability of corporate law disputes has been a highly controversial issue. Many opinions have been put forward in the discussions so far and these opinions have been based on various reasons. In our study, each of the reasons relied upon in the doctrine regarding the arbitrability of corporate law disputes is examined within the scope of national and facultative arbitration, and some disputes are analyzed together with the discussions; publicly traded companies are excluded from the scope of our study. All these data are analyzed with the decisions of the Court of Cassation / Regional Court of Appeal in the past and the present, and it is concluded that a positive perspective on arbitrability is developing and reflected in practice in Turkish Law.
