Abstract (EN)

Cultural possesions and historical areas which are concrete images of town memory and identity were previously tried to be protected by non literal rules related to needs and religious believes and by 19th century with national and international legal regulations developed towards the efforts of forming protection principles in Europen in which the understanding of protection was developing. Conservation laws and related legal regulations developing as an example of the legal regulations of European Union member countries in this field in Turkey and changing with the experiences and formal transformations have become indicator both of cultural possesions in the context of single form and of the protection of historical places in the context of areas. By reviewing the changes and transformations of protection laws which are direct indicators of forming of pysical place and in implication and take the role of forming the pysical place and direct the town planning by periods from the time it first occured to date, the advantages, risks and opportunities of the said legal regulations were tried to be determined. In this context the subjects was examined by all protection laws and related legal regulations developed specifically for Turkey beginnig with the European measure. Consequently, the evaluation of the changes in laws, decisions about conservation and decisions of public work executed independently from the protection efforts were done and, the change of pysical place was put aside by reviewing the decision process about "the buildings under protection" on İzmir Mithatpaşa Street.
