Muhammed b. İbrahim al-Baqquri's understanding of usûl in the context of his work Tertibu'l-Furuk

In this thesis, we examined in detail the legal approaches of the Malikî jurist, Abu Abdullah al-Baqqûrî, who has almost never been referred to in the literature, in the context of his work named Tertîbu'l-furûq. In the first chapter, we discussed his biography, works and the scientific, cultural, and political structure of the geography which he lived. Briefly Baqqûrî, was born in Andalusia in the VII/XII. century and after completing his first education here, he moved to Maghrib and settled in Marrakesh. There is very little information about his life, teachers, and students in the resources. Also, in this chapter, issues such as the Qarâfî's biography, works, and furûq literature which are indirectly related to our research topic, are briefly touched upon. In the second chapter, we examined Baqqurî's contributions to teacher Shehabeddin al-Qarâfî's work named Furûk, which has a very important place in the literature of furûq through various examples under the titles of tertîb, telhîs, and istidrâk. Baqqûrî's objections to his teacher under the title of "Istidrâk" are the most remarkable subject of this chapter. We tried to determine the place of Tertîbu'l-furûk in the field of Islamic law and particularly in the furûk literature. In the last chapter, Baqqûrî's methodological approaches were examined. We discussed especially issues such as many of the thirteen principles that he identified regarding the theory of maslaha, the reflections of the hadithist aspect on his fiqh views, and his views outside the doctrine under separate headings. His competence in the field of Arabic language and its legal implications, his view of customs, his legal inferences using the principles of istishab and necessity are also among the topics we examine in this chapter.
