Abstract (EN)

The concept of "damage", which is expressed as the diminution related to personal assets or assets of persons as a result of illegal acts, can appear in many varieties in the ordinary course of life. Damage has been subjected to various distinctions, by considering many criteria due to especially it is one of factors of tort liability in the Law of Obligations. The type of damage, which has many types such as material damage, moral damage, direct damage, indirect damage, if it occurs or whether it can be compensated in case of occurrence, may vary depending on the concrete situation and legal regulations. In compulsory traffic insurance and voluntary financial liability insurance; It is also an important issue in this regard that the compensation of the types of damages that may demand from the insurer if the risk occurs. In the first part of our study, the concept of "damage" is clarified and what loss means in terms of insurance compension is mentioned. Then, the types of damages and the types of assurance which the insurer is held responsible under Highways Traffic Law are discussed. In the second part, the damages that are and are not inclusive of compulsory traffic insurance and voluntary financial liability insurance are examined. Then, a brief evaluation about the legal nature of the general terms of insurance is carried out. Lastly, in the third part of our study, the documents that should be applied to the insurer for compensation of the damages are in the scope of compulsory and voluntary traffic insurances and the methods which based on compensation calculations as a result for duly application are discussed.
