The Serial Judgement Procedure in Turkish Criminal Law

Abstract (EN)

Recently, there has been a serious increase in crime rates in our country due to the increase in population or other reasons, and many searches have been made in alternative resolution dispute ways in our Criminal Procedure Law in order to reduce the increasing workload in Turkish judicial system. For this purpose, the application area of the institution of conciliation has been expanded day by day, as well as alternative settlement dispute institutions such as Prepayment and Postponement of inititation of Public Prosecution in order to reduce the unusually increasing workload in criminal courts, have also found application in Turkish law system. The "Serial Judgement Procedure" was introduced into Turkish Criminal Procedure System with the Law No. 7188, which was published in the Official Gazette on 24.10.2019, to these alternative dispute resolution methods. With this new institution, it is aimed to accelerate the lengthy and almost avalanche-increasing trial activities, to a certain extent, by the proposal of the Public Prosecutor in terms of a number of catalog crimes, the acceptance of this by the suspect in the presence of his defense counsel, and the adjudication after being approved by the court. With this new institution, a suspect renounces some of his rights, but in this way, the penalty he will receive is reduced by half. It is also very important that the suspect does not experience any loss of rights within the scope of the right to a fair trial, which is guaranteed by the constitution. In this study, the place, purpose, legal nature of this new institution that is called The Serial Judgement Procedure the conditions of application of the accelared trial procedure and the situations in which it cannot be applied, and its results will be explained in Turkish law. The differences will be mentioned by making comparisons with other alternative resolution dispute methods in Turkish Criminal Law, finally, it is aimed to benefit Turkish Criminal Law by making suggestions for further improvement and development of the institution.
