Drug or stimulant substance crimes trade in criminal law (M.188/3)

Every society is struggling with drugs and stimulants for a healthy social system and to ensure their continuity. Drug trafficking was considered a legitimate trade until the middle of the 19th century, but After this time, The spread of trade of this substance, the increase of consumption in some countries have carried the dangers of drug to large size. Therefore, at the face of this growing threat, the countries have started to take precautions and they have started to legalize to this precautions. Drug and stimulant production, trafficking, use, as each country is a major threat to Turkey. Therefore, Our country is taking measures with certain regulations and is performing with its own bodies in order to maintain its own unity and integrity and to create a healthy society. But of course the problem of drug and stimulant is not just a problem of Criminal Law. It is a problem that almost all the terms of the community must act in cooperation to find a common solution to this problem and to combat. Our study have been prepared for the purpose to research, examine and evaluate along with other national and international legislation to the regulations about drug and stimulant trafficking crimes in the Turkish Criminal Code . İn this study, regulations about the Turkish Criminal Law, many books, theses, journal, articles, reports, web pages were used. In the first part of my study; The concept of drug or stimulant, types, the development dimension of drugs and stimulants crimes and controversial drugs or stimulants were dealt. In the second part of my study; international labor about stimulants and drug were dealt. In the third part of my study; Drugs and stimulants in Turkish Criminal Code that located under the Article 188/3 of the Act were discussed in detail and the changes made under this article, the debates on the subject were examined comparatively and the development of drugs and stimulants offenses were be considered as a summary under the Turkish Criminal Code. At the conclusion of the study; drugs and stimulants trafficking offenses will be considered as a summary under the Turkish Criminal Code Article 188/3 and will be given to the issue as to which methods should be consulted in the fight against trafficking.
