Abstract (EN)

The crime of sexual abuse of children is regulated in the second book of the Turkish Criminal Code No. 5237, the second part of the special provisions in the second book, the sixth section where the crimes against persons are regulated, under the subtitle of crimes against sexual immunity, and is regulated in Article 103 of the Law No 5237 titled as sexual abuse of children. This research addresses the issues of what the concepts of child and abuse are, what exactly the crime means, its history, the position of the crime in comparative law, its differences with other similar crimes, its regulation in the code, its sanction, illustrative decisions on the crime in high court decisions etc. In this study; The first part of the study discusses the concepts, the historical development of the crime, its place in international regulations and the way it is regulated in comparative law. The second part considers the way the crime is regulated in the Turkish Criminal Code (Art. 103). In the third part, the provisions of the crime related to the judgment, the intervention of the Ministry of Family and Social Services in the criminal files for this crime and the similarities and differences of the crime with other crimes against sexual inviolability are discussed.
