Abstract (EN)

At the present day, human rights become a considerably popular concept. In fact, human rights are the rights that result from human?s being a respected being from the beginning. Just being a human is enough to have these rights.The most effective way of preserving the human rights is to provide a fair judging system. Besides, right to a fair trial, which is a human right, is the security of all the other rights. Right to a fair trial is generally mentioned with the concept of justice. In the first chapter of the present thesis the concepts of justice and right to a fair trial are explained in general. In the second chapter, leading international documents that have been obtained on the right to a fair trial and their effects on Turkish law are examined. The third chapter focuses upon the effects of international arrangements about human rights and the right to a fair trial on Turkish domestic law. In addition, both the arrangements that were made in Turkish Penal Legislation in order to provide the right to a fair trial and the contribution of these arrangements to the right to a fair trial are examined. International agreements about human rights and the right to a fair trial to which Turkey has become party are focused on. European Convention on Human Rights which is especially important for the application of the domestic law, the case law of European Court of Human Rights which is the audit mechanism resulting from European Convention on Human Rights and the contribution of the change in the legislation to a fair trial are examined. It is also studied that whether these changes have contributed to the application of the right to a fair trial or not.
