Dispute resolution methods similar to arbitration under Turkish law

Abstract (EN)

This study primarily examines the methods stipulated in the Turkish legislation regarding the resolution of private law disputes outside the state jurisdiction and determines the relationship between arbitration and arbitration-like methods, and the concept of alternative dispute resolution and the differences between arbitration and arbitration-like methods, and peaceful methods. The formal or functional similarities with the general arbitration regulations are presented through examination of the dispute resolution methods envisaged by the regulations other than the general arbitration regulations in the Turkish legislation, the source of each dispute resolution method, the competent authority for such dispute resolution, the results of the application to the relevant procedure, and finally the provisions and consequences of the decisions. The issues that should be considered, especially in terms of the protection of the right to a fair trial, are evaluated in relation to such regulations, which are scattered around the Turkish legislation.
