Abstract (EN)
The subject matter of intellectual property rights is constituted by intellectualeffort products which carry ecenomic value. These rights are composed of twodimensions : economic rights that take part in work owner`s assets and moral rightsthat are related with the work owner `s personality rights.The scope of intellectualeffort products includes not only intellectual and artistic works but alsotrademarks, patents , industrial drawings and models. In a broad sense, theintellectual property rights enclose both industrial rights and rights on intellectualand artistic works. In the scope of the this study, first intellectual property rights arediscussed in a general sense, then intellectual rights ( or the notion of copyright as it`s used in practice ) which compass intellectual and artistic works solely, arefocused on.This study consists of two chapters .In the first chapter, as it?s seen from ourtopic, after making a short introduction to the intellectual property concept,international treaties and organizations regarding to this issue are mentioned. Inorder to determine the exact place of institutions protecting intellectual propertyrights in the scope of Turkish administrative structure, it has been tried to stateexpressly the organizations in Turkish Administrative Structure. By making theanalysis of institutions in Turkish Administrative Structure , within the framework ofdependent, concerned or related establishment structuring , it has been tried toprovide clarification to the concept of independent administrative authoritiesIn the first chapter, generally, within the context of `? the protection ofintellectual property `? title, the way of protection in Turkish administrative structure isshortly emphasized.Then the comparison of the institutions which are responsiblefrom the protection and development of the intellectual property rights arepresented. In this context, it has been tried to determine the situation of GeneralDirectorate of Copyright and Cinema and Turkish Patent Institute in the Turkishadministrative structure. In addition to the history , tasks and administrativestructures of mentioned institutions , especially the legal structure, problemsrecognized within the current administrative structure, range of activities andauthorization of the General Directorate of Copyright and Cinema has beenexamined in detail. After putting forward generally the main legal ground regarding tothe necessity of restructuring of the General Directorate of Copyright and Cinema ,the proposals that are foreseen for the restructuring of the Directorate are discussed.In this context , three establishing draft laws which are prepared in order to benefit inthe process of the restructuring of the Directorate are presented. These draftshandle dependent, concerned or related establishment structures seperately andgive important administrative details for these three different structures
