Abstract (EN)
This study has been prepared in order to examine the transition regime from closed penal execution institutions to open penitentiary institutions in the context of the special prevention purpose of punishment. In particular, the transition issue between the rehabilitation purpose, which is the most important part of the special prevention purpose of the penalty, and the penitentiary institutions will be discussed in the light of the current regulations and in a way that will allow some suggestions. In order to achieve this aim, first of all, the concept of punishment, the theories related to the purpose of punishment, the historical formation processes of prisons and penitentiary systems will be illustrated. Subsequently, by examining the regulations in our country, the transition from closed penal institutions to open penal institutions and the issue of return from open penal institutions to closed penal execution institutions will be revealed in all details. In the conclusion part of the thesis, in the light of the information stated in the previous sections, open penitentiary institutions and the institution of separation into open penitentiary institutions will be evaluated in terms of ensuring the special prevention purpose of punishment.
