Abstract (EN)
Due to the fact that the provisions of the legislation on military discipline are not in accordance with today's conditions, the Turkish Armed Forces Discipline Law No. 6413 entered into force on February 16, 2013. In this article, the provisions of the previous legislation and its applications and the principles of the new law were emphasized and short comparisons were made with the disciplinary provisions of the Civil Servants Law No. 657. In matters such as disciplinary punishments, the powers of disciplinary supervisors, the rules applied in the process of punishment, and the openness of the judiciary to certain disciplinary punishments, the principles of military discipline are very similar to those of civil servants disciplinary law. There are, however, important differences between the two laws. As a result, the new law is considered to be a fundamental deficiency, especially in the fact that the European Court of Human Rights is capable of meeting the decisions of the European Court of Human Rights on the subject of "chamber imprisonment" and "disciplinary courts" and the fact that the penalty for not leaving the service, which is a binding punishment, is not fully open to judicial proceedings against all of the disciplinary penalties.
