Inspection of labour life and methods of fight against informal employment in Türkiye

Inspection is the most effective method to prevent abuses. In this context, the inspection of labour life protects the interests of employees, employers and the state. The inspection structure of labour life in Türkiye consists of three inspection units based on labor and social security law. In this respect, the authority to supervise labour life has been given to the Ministry of Labor and Social Security (MLSS). This authority regarding labor law belongs to the Labor Inspectors working within the Ministry. The Social Security Institution (SSI), the relevant institution of the Ministry, conducts audits in the field of social security law by Social Security (SS) Inspectors in the central organization and SS Auditors in the provincial organization. Therefore, this tripartite inspection structure consisting of Labor Inspectors, SS Inspectors and SS Auditors negatively affects the effectiveness of the inspection. This negativity also complicates the fight against informal employment. The inspection of labour life in Türkiye should be handled with a holistic approach and labor legislation and social security legislation should be evaluated together. Inspection activities in these two areas should be carried out by a single unit and the same inspectorate. This will reduce public expenditures and ensure efficiency in supervision, while ending the pressure on employers to carry out triple inspections. In this context, the inspection of labour life has been analyzed with a focus on inspection within the scope of the relevant legislation, taking into account the historical process and the current situation, and the shortcomings in the inspection structure in the context of combating informal employment have been revealed. The problem of the research was supported using statistics. The findings obtained as a result of the research as a whole were evaluated and suggestions were made regarding the need to restructure the control structure of labour life.
