Employment of foreigners in Turkey

Abstract (EN)

Foreigner employment has been implemented all over the world in different ways for thousands of years and become very important by acquiring a different dimension with globalization. However, about foreigner employment in Turkey it is clear that it is experienced difficulties and has some deficiencies. Therefore, it has been thought that making a thesis research in this subject will be beneficial.As the subject is examined, it is explained the current situation in Turkey following historical development of foreign employment. Illegal employment is not detailed by considering the scope of the subject.The law no. 4817, Law on Work Permits of Foreigners, is enacted in 2003 in order to regulate foreigner employment in Turkey. Within the frame of this law, in the thesis it has been evaluated some issues such as how to get work permit, who can apply for work permit, requirements to get work permit, jobs which is not allowed for foreigners and rights and obligations for foreigners who get work permit. Furthermore, it is explained statistical data about the number of foreigners who get work permit, their occupations and positions.Foreigners who came to Turkey by getting work permit have been able to work in jobs and work place/business which they get permission. Foreigners who have work permit can benefit in the same way from the rights such as wage, social security, overtime pay, transportation services which Turkish citizens have. In addition, they have some obligations such as paying tax, social security premium, not working except for jobs and work places permitted.In brief, foreigner employment is a highly important term,but the significance of this subject has not completely understood in Turkey. Although there are some articles in different laws about this subject, it is needed a new legal regulation on behalf of providing integrity in implementation and preventing confusion.
