Abstract (EN)

The principle of equality was adopted through the operation of Article 10 under the Constitution of 1982 which regulates the residency and freedom of travel which is also encompassed in Article 23. In fact, the expression of "everyone" in this Article of Constitution has been emphasized that there is no difference between foreigners and citizens. According to Article 16 of the Constitution, the freedom to travel and establishing residency by a foreign is limited by law in accordance with international law. The Law no. 6458 Law on Foreigners and International Protection (LFIP) came into force on 4th April 2014 which is a basic stem of regulation that restricts the freedom of travel and settlement based on the principle of equality in the Constitution. The issue had arranged Law on Residence and Travel of Foreigners in Turkey (LRTFT) before the Act comes into force. However, in 1950 dated the LRTFT was criticized for being inadequate in today's conditions. LFIP was prepared and drafted based on these criticisms and applicable needs. LFIP contains detailed provisions about the type and conditions on the residence of foreigners and, extension or cancellation of the residency time period. In fact, the right of residence and travel of foreigners in the frame of the provisions of the LFIP was chosen as a subject of dissertation because there is not any monographic study in this subject .Thus, the aim of this study is to contribute to the Turkish legal literature.
