Abstract (EN)
The research subject of the thesis is related to the liability for associates, which is regulated in art. 116 of Turkish Code of Obligations. The thesis will discuss the conditions of this responsibility and irresponsibility agreements and controversial issues. Source Swiss Code of Obligations (especially art. 101 "Haftung für Hilfspersonen") and the German Civil Code (especially paragraph 278 "Verantwortlichkeit des Schuldners für Dritte"), judicial decisions and doctrine on controversial issues will be examined. There will be an examination with a wide perspective from Roman Law and the related terms like Slavery, to the terms like Artificial Intelligence and Robots, related to future. At the required points, various country laws, such as "especially Switzerland and Germany", Austria, Italy, France, Portuguese, Nederland will be compared and also there will be references to sources such as Roman law texts, maxims, international works like UNIDROIT/PICC-DCFR-PECL-CISG-CESL and Majelle (Ottoman Code of Civil Law). In particular, numerous and unique examples will be given.
