Earthquake and legal liability in the context of judicial decisions

Our country is located on the most active fault lines of the earth and is exposed to earthquake danger at any time. In addition to the occurrence of great material and moral grievances due to earthquake disasters, many different legal disputes also arise. The damage caused by earthquakes is much greater than other types of disasters and occurs in much different areas in terms of impact. The multidimensionality of the damage caused by earthquakes also causes the legal disputes that arise to be multifaceted. Both administrations and individuals have different legal responsibilities due to earthquake disasters. However, in many concrete events that develop after earthquakes, legal responsibilities are not clearly separated from each other and appear in an implicit manner. The aim and goal of our study is not to repeat the general issues that exist in almost all textbooks, theses or articles. As of the date of writing, it is aimed to find out who is responsible for the damages suffered by people who have suffered from the earthquake centered in Kahramanmaraş on February 6, 2023, and whose number exceeds millions, and to evaluate the legal quests of lawyers who will help them in this regard from different perspectives, to systematically present and discuss modest solutions in a systematic manner by considering various possibilities in the light of legislation and judicial decisions. In addition, since our study is application-oriented, high court decisions belonging to many different judicial branches have been examined and in the context of these decisions, it is aimed to contribute to the multifaceted and multidimensional disaster problems that occurred after the earthquake and to the determination of legal disputes between administrations and individuals and to the determination of legal responsibilities. However, our study is only devoted to the earthquake disaster individually, but efforts have been made to adhere to general principles and basic legal rules.
