Abstract (EN)

The disposition principle and the principles in relation to this principle, i.e. the principle of adherence to plea, the principle of contest and the principle of concentration, form the basis of the civil proceedings. It is especially required for these principles to constitute the essential character of the civil proceedings system and to be taken into consideration in every dispute in order to provide the continuity of the proceedings. Even though most of the dominating principles of civil proceedings are enumerated in the Code of Civil Procedure, no legal sanction is provided as a consequence of not complying with these principles. In this dissertation, the meaning of not complying with these principles needing be taken into account through the civil proceedings, what constitutes the violation of these principles, and which legal remedies are to be invoked in case of violation of these principles are attempted to be elucidated.
