Mustafa İbrahim ez-Zülemî'ye göre nesh / al-Naskh from the point of view of Mustafa Ibrahim az-Zulmi

This thesis aims to explain the concept of Al-Naskh and its rulings according to Dr. Mustafa AZ-Zulmi (d. 1924 AH / 2016 AD) through what he wrote on Al-Naskh in his various books on the Fundamentals of Islamic jurisprudence. The importance of this study stems from the fact that it dealt with the issue of Al-Naskh, which is a subject of great controversy among scholars after Imam Al-Shafi'i composed his treatise on the principles, the dispute arose in the issue of Al-Naskh to this day between affirming Al-Naskh and denying it. Mustafa AZ-Zulmi is one of the scholars who have contributions to the science of jurisprudence in the modern era - especially in the issue of Al-Naskh - as he is not interested in abstract transmission devoid of his tracks and opinions, and the scope of this study is determined by his book (Al-Tibyan Fi Al- Naskh; And Al-Ahtaa Al-Usuliyah Fi Jami Al-Jawami). The researcher followed the historical descriptive approach when reviewing the biography of Dr. AZ-Zulmi and his scientific works, and the descriptive analytical-comparative approach when presenting the views of the historical descriptive approach when reviewing the biography of Dr. AZ-Zulmi and his scientific works, and the descriptive analytical-comparative approach when presenting the views of the fundamentalists about copying and then comparing them with AZ-Zulmi's opinion. The study concluded with a number of results, Including: that Az-Zulmi does not deny AL-Naskh altogether, and does not accept AL-Naskh in the type that the scholars decided and wrote in it, but rather set other conditions for it, and he also believes that what many scholars call AL-Naskh is originally a specification, which is clear to us through this research that the view Az-Zulmi to AL-Naskh was not a view of denial and opposition, as some believe, rather he wanted to follow the approach of the predecessors in understanding AL-Naskh, as they believed that AL-Naskh is either the lifting of the ruling, or a general specification or an absolute restriction or a general clarification, and not as the latecomers see it.
