Abstract (EN)

The general system of Islamic law (sharia), the establishment and application Abdelrahman El – Desouki Islamic law (sharia) came to look after the interests of servants of Allah in the present life and the Hereafter, and to organize their affairs, and facilitate their lives, and therefore the manifestations of justice and mercy in all visible aspects. Every nation of nations must have a regulator to control their lives and follow. Unless they find what could unite them, they will be lost in the darkness of segmentations and conflict. so Allah make the laws(shar') to be a lamp to illuminate the peoples' way; when some tried to leave it and isolate from it, they could not live without unity, then replace the divine light with constitutions and statutes, and they are completely different! While Allah awarded us with Islam and the mercy of shari'a, the researcher tried to touch the parameters of this system in the provisions of the Sharia; The research was an attempt to extract the features of this system and the statement of structure and purposes as well as an attempt to explain many of the branches of jurisprudence that are involved in building the general system of Islamic law. Therefore, this research is concerned with the definition of the concept of the public order, its origins, its demonstration and its purposes; it is also interested in mentioning the branches that have fallen under the public order by extrapolating the books of jurisprudence and extracting the correct provisions to be within the public order. Key words: public order, its origins, its purposes, interpreter, arbitrator, absolute consensus, general rules, the right of others.
