Abstract (EN)

This study examines the term "al-Asl" (the Origin/Principle) as utilized by Hadith scholars, exploring its genesis, linguistic and technical meanings, and its critical applications in evaluating prophetic narrations. The research aims to clarify the term's significance in Hadith sciences and uncover its various connotations based on the statements of critical scholars (nuqqād). It includes an extensive applied study focusing on one of its specific uses: "asl fī al-bāb" (a principle/origin in the chapter) in Sunan Abī Dāwūd. The study is divided into two main chapters: Chapter One provides a theoretical study, covering the historical emergence of "al-Asl" and the prominent scholars who used it. It also delves into its linguistic and technical meanings and its diverse connotations (absolute or restricted, affirming or negating). Furthermore, it defines the Hadith that scholars described as "lā aṣla lahu" (it has no origin/basis) and discusses its ruling. Chapter Two presents an applied study, involving a comprehensive survey and analysis of Hadith narrations described as "asl fī al-bāb" in Sunan Abī Dāwūd. These Hadith are categorized by their jurisprudential topics, with an analysis of the intended meaning of the term in each context, a clarification of the jurisprudential ruling, and a discussion of the preferred opinion among different scholarly views. The researcher employed an inductive, analytical, and critical descriptive methodology. This involved collecting relevant texts, analyzing them in light of critical scholars' statements, and inferring the impact of "al-Asl" on guiding their judgments regarding Hadith and in issuing jurisprudential rulings. The study's significance lies in its focus on a precise term that, to the best of the researcher's knowledge, has not been the sole subject of a specialized academic study combining theoretical grounding (ta'ṣīl) with practical application. This makes the dissertation a qualitative addition to the field of studying Hadith terminology used among scholars.
