El-kavâid ve'd-Davâbıt el-Fıkhiyye fi'l-buyû' min Kitâbi'l- Hidâye li'l-Merginânî

The jurisprudential rules and regulations form an important part of the Islamic Jurisprudence. However, this discipline (Jurisprudential rules and regulations) has been given a colossal importance by our scholars, who extracted its rules from Quranic and prophetic texts then explained them thoroughly. The Scholars mentioned the jurisprudential subcategories beneath these rules; thereafter, the books about this discipline took a broader dimension to include its foundation and the phases that it has been through. This discipline has no little importance for those who study Fiqh and its foundation; hence, it justifies the aims of legislation, the logic of its justice and nurture the researcher's jurisprudential faculty; moreover, it helps to know the jurisprudence's sources and intricacies, and to find new solutions for modern issues. In this thesis, I explored the Jurisprudential rules and regulations that I could find in al-Hidaya book, Sales chapter by Imam al-Marghinani then I explained them, and I mentioned their subcategories and what the scholars excluded from them. This thesis contains an introduction, preliminary chapter, and three chapters. The introduction contains the thesis topic, its motive, the reason behind choosing it and the methodology I followed. The preliminary chapter contains two sections: the first section: the biography of Imam al-Marghinain. The second section: an introduction for Al-Hidaya book. The three chapters: The first chapter: the definition of the words "rule" (qaida) and "regulation" (dhabit), other relating words, and the foundation and phases. The second chapter: the jurisprudential rules in alphabetical order, their sources and implementation The third chapter: The jurisprudential regulations in alphabetical order, their sources and implementation Finally, I ended up the thesis with the results and recommendations that I reached to and I added at the end an index for better search quality.
