Abstract (EN)

In this thesis, crime of homicide in Istanbul 18th century is included. Firstly, the theory of the homicide is explained on the basis of the fiqh books which are respected in Hanefi / Ottoman law. Then, the relationship between theory and practice is revealed through various archive documents related to the criminal registers, fatwa books and Ottoman court records (şeriye sicilleri). This study reflects to the homicide in Ottoman law which is a late implementation of Hanafi law. This thesis does not include only the court records to show the implementation of the law. Additional to these records, several archive documents which are related to the punishment of retaliation and which became an issue at the Dîvan are also analyzed. Respectively, the process of ruling of domestic courts and Dîvan is analyzed. It is observed that there is an conformity between theory and practice in spite of some differences.
