Abstract (EN)
Today many governments plays controller and regulator role in all fields. This role is described by the concept of regulation. Regulation are divided into groups in accordance with types, method and purpose: financial, administrative and social regulations. The main purpose of the regulation is to increase the productivity and effectiveness of the field that is going to be regulated. Social regulations are implemented for the purpose of protecting environment, health, public moral and future generations. Therefore, governments even include social state principle into their constitutions and run social regulatory policies in accordance to their constitutions. Struggling against alcoholism placed in the forefront among the social regulation policies. Many countries fought against alcoholism between 1918 and 1938. Additionally, countries like Russia, Canada, Norway, Hungary, Turkey, the USA and many others countries either limited the use of alcohol or banned it. Turkey and the United States, where alcohol is seen as the source of social problems, have imposed alcohol prohibition in order to dispose alcohol from the society. It is banned in the United States between 1920-1933 by the ratification of Volstead Law in order to complete 18th Constitutional Change, while, In Turkey it is prohibited by the Intoxicants Law. These legislations, which are presented as prescription for social problems, are not achieved a goal, whereas, implementations have become insufficient, finally the legislations have been removed. This study will take the reasons, legislations processes, experiences and abolition of the legislations of the social regulatory policies that are implemented in Turkey and the United States between1918-1938 in the context of the data obtained in literature review. Additionally, comparative and comprehensive analysis of both cases will take place in the light of the data.
