Social state governed by the rule of law according to 1961 and 1982 constitutions

The aim of this study is to put forward the understanding and applications ofSocial State Governed by the Rule of Law in Turkey, as regards to 1961 and 1982constitutions, in respect to the universal requirements of the concept ?Social StateGoverned by the Rule of Law?. In our study, we pointed out the definition, historicaldevelopment and requirements of the Rule of Law State, transition from Rule of LawState to Social State Governed by the Rule of Law, the definition, historicaldevelopment and requirements of the Social State Governed by the Rule of Law, itsdevelopment in Turkey, the acts which are to be found in 1961 and 1982constitutions related to Social State Governed by the Rule of Law, the applications ofSocial State in Turkey and the verdicts of the Supreme Court related to the SocialState Governed by the Rule of Law.The study consists of three parts. The first one is ?Introduction?. In thesecond part, there are six sections under the title of ?Institutional Bases and RelevantLiterature?. In the first section, the definition, elements, forms and historicaldevelopment of Rule of Law State are pointed out. In the second section, thedefinition, elements, forms and historical development of The Social State Governedby the Rule of Law are stated. In the third section, the acts related to the Social StateGoverned by the Rule of Law in 1961 Constitution are given. In the fourth section,ivthe acts related to the Social State Governed by the Rule of Law in 1982 Constitutionare given. The applications of Social State Governed by the Rule of Law in Turkeyare expressed in the in the fifth section. In the sixth section the verdicts of theSupreme Court related to the Social State Governed by the Rule of Law areindicated. Finally, the third part consists of the interpretations of the acquired dataand the results section.Key Words: Rule of Law State, Social State Governed by the Rule of Law
