The application problems of Public Procurement Law at number 4734 at construction affairs and solution proposals

In developing countries most of the investments are made by governmental institutions. The inadequacy of the laws that organize the performance of these investments results in some problems in the mechanism of the process. In order to cope with these problems, some measures should be taken by the related institutions.In the expenses of public sector which is the purchaser in the national economy, the main goal should be increasing the efficiency and productivity through the dissipations. Especially in developing countries one significant point is that there should be an efficient public purchase system which is performed properly.It is clear that there are some defects in the 4734 Public Procurement Law which is being applied in our country. It should not be forgotten that existing deficiencies and faults in applications should be considered in a perceptive way. The applicability level of this law is tired to be increased through the secondary legislation law by Public Procurement Authority. Public institutions in the mechanism of the process, contractors that seems in an ambitious position in the bids of public institutions, non-governmental organizations and other institutions declare that there should be arrangements and measures in order to regulate the Public Procurement Law. During the preparation of this study, the draft law that includes changes in the 4734 Public Bid Law is submitted to TBMM ( Turkish Ground National Assembly).In this study 326 complaints, about construction affairs bids that were applied to Public Procurement Authority during the implementation process of Public Procurement Law, are examined. As a result of this analysis, the focal points of incompatibilities are identified and examined in details. At the end of this examination, it is understood that the imperfections should be corrected and necessary measures should be taken.
