Abstract (EN)

The employer's obligation of equal treatment in Article 5 of the Labor Law is one of the articles in which the employment contract, which is one of the employment contracts, is limited within the scope of the freedom of contract and is stipulated for the protection of the employee who is dependent on the employer. The employer's obligation of equal treatment and the prohibition of discrimination, which finds material regulation with the Labor Law No. 4857, are supported by the Constitution and various international conventions in our law. Although the legal regulation prohibits the employer from discriminating between the employees, different treatments that can be justified by objective reasons will not be a violation of the obligation of equal treatment. Violation of the obligation of equal treatment and the conditions of compensation for discrimination that can be claimed in this case can also take place in practice with the decisions of the Court of Cassation.
