Abstract (EN)

The internet, which emerged with the rapid development of technology, has become a part of human life today. The diversification of the usage areas of the Internet and the increase in its use among individuals have increased the interaction between individuals by enabling the establishment of various social media sites over time. Social media users can use other people's works in their posts, as well as share their original works. This sharing culture has led to legal disputes in the context of intellectual property. In social media, the rights of the author arising from the work can be violated in various ways. Since social media is a relatively new field, the ways of violations are new and diverse. It has been discussed throughout our study in the light of national and international regulations whether the Turkish legislation adapts to the dynamic structure of social media and whether it is sufficient to protect the rights of the author against violations made using technological means. Because, although some legal regulations have been made in our laws in the context of internet and social media, we do not yet have a comprehensive legal regulation. Within the scope of our study, we will discuss how technological developments affect the work, the author and the owner's rights within the scope of our legislation, how traditional legal solutions can be applied within the scope of social media, and the adequacy of the legislation.
