Abstract (EN)
In this study, we examined the risk area and structure determination and their legal consequences based on Law No. 6306, the compliance of the related regulations with the constitution and the administrative law were examined by attributing at the types of intervention required by law. Being repeated the provisions of laws and regulations in most of scientific studies published since the entry into force of the law, caused us to prepeare this study. Giving the administration an effective role in these practices and continuation of the process with administrative acts, conduced to examining the issue within the scope of administrative law principles. Solutions suggestions, for eliminate the regulations that we think contrary to the constitution and the rules of administrative law, were presented in this study by referring to the legal consequences resulting from risk area and structure determination process based on Law No. 6306.
