The authority to conclude collective labour agreement within the context of the Law on Trade Unions and Collective Labour Agreement numbered 6356 and evaluation under the international norms

The Law on Trade Unions numbered 2821 and The Law on Collective Labour Agreement, Strike and Lockout numbered 2822, which were both entered into force on 05 May 1983, on the same day, have been ceased to have effect following the entry into force of The Law on Trade Unions and Collective Labour Agreement numbered 6356 on 07 November 2012 after 29 years. When we examine the General Preamble of The Law on Trade Unions and Collective Labour Agreement numbered 6356, we can point out that the purposes of the law amendment are to adapt with the changes made in the Constitution by the referendum hold in 2010, to restrict the limitations considered as non-liberal for trade union rights, to find the solutions for the problems in practice and to comply with the provisions of Right to Organise and Collective Bargaining Convention, 1949 (No. 98) and Freedom of Association and Protection of the Right to Organise Convention, 1948 (No. 87) of International Labour Organisation (ILO) which were approved by Turkey. The subject of this thesis is restricted by "The Authority to Conclude Collective Labour Agreement" within the context of the Law on Trade Unions and Collective Labour Agreement numbered 6356. Where deemed necessary, comparisons with the repealed legislation and the evaluations under the international norms were made.
