Housing sales agreement on the basis of advance payment within the scope of Consumer Protection Act No. 6502

Housing Sales Agreement on the basis of Advance Payment set out in Turkish Legal System for the first time in 2013 between Article 40- 46 of Section 4 within the scope of Consumer Protection Act no. 6502. We are of the opinion that making an examination in order to determine on convenience of the relevant Code to the cases which arise from the relations between consumers and sellers in their daily life and handling the possible problems which we assume that they will be coming up in the future, are necessary on the grounds that these articles, which set out for the protection of consumers against the construction sector which is growing day by day, are excessively new. Considering legal doctrine in the relevant field and legal precedents, we tried to explain our opinions and examinations in relation with the preparation of housing sales agreement on the basis of advance payment as per the Code and Regulations and problems of the parties which come up in the procedure of agreement preparation and also during term of the agreement over the remarkable disputes in practice.
