Abstract (EN)

This thesis aimed to study and investigate the book of Tashkubrizade (d. 978/1560), one of the most famous jurists of the Hanafi school of Fiqh in the tenth century AH, which he called: "Sharhu Muqaddimati as-salat by al-Fanari". In it, he collected all the issues related to prayer, including its pillars, conditions, forms, and parts, along with their evidence, and presented many of the sayings of the Hanafi jurists, in addition to the saying of the Imam: such as the sayings of Abu Yusuf, Imam Muhammad, al-Sarkhasi and other scholars from sources that are still in manuscript to this day. Al-Fanari's introduction to prayer is one of the important explanations in Hanafi jurisprudence that has received explanation and commentary, such as the explanations of al-Quhistani (d. 950/1543), al-Aqhasari (d. 1025/1616) and al-Nablusi (d. 1143/1730). The study included collecting the chapters of this book. The study reviewed 12 copies of the manuscript, and the historical descriptive approach was followed when researching the biography of the two imams: Al-Fanari and Tashkubrizade and reviewing their biographical and scientific biographies. In the investigated section, the interview approach was followed, which is based on comparing the written copies, capturing the differences between them and noting them in the margin. With the graduation of sayings and texts contained in the text and attributing them to their sources. The results of the study were that Tashkubrizade's attention to presenting evidence from the Qur'an, Sunnah, and the sayings of scholars, and attributing the sayings to their sources. He quoted more from "Muniyat al-Musalli" by Muhammad al-Kashgari. Most of the commentators mentioned the rules in the structure of sentences, which many long books do not have, and this is what explains the interest of scholars in it and its adoption in education and teaching. It also included precise branches that are not found in jurisprudential texts, such as branches of etiquette, sunnahs, and things that are disliked. The commentator's method in the book was based on choosing between the sayings of the imams of the Hanafi School of jurisprudence, and then giving preference between them according to the proven evidence from the Qur'an or the Sunnah or the general rules for giving preference. He also conveyed the jurisprudential differences to the rest of the Fiqh schools, especially the Shafi jurisprudence and he touched a lot on mentioning the reasons of rulings, which indicates a broad culture of the commentator.
