Abstract (EN)
Adam Ferguson is one of the Scottish Enlightenment philosophers. In this study, the role of the civil society approach of Adam Ferguson in shaping the relationship between law and politics in modern society will be tried to be explained. In the study, the developments in England and Scotland in the 18th century, the tradition of the Scottish Enlightenment, and the ideas of the philosopher's two important contemporaries will be included. Ferguson's perception of law will be examined in detail based on his moral philosophy and understanding of civil society. Ferguson's dualist approach to law in terms of ethics and social order will be emphasized, and the reasons for considering law as a result of civil society will be discussed. It will be possible to have an idea about the foundations of the relationship between law and politics by the help of the philosopher's views.
