Abstract (EN)

The determination of non-pecuniary damages, which is one of the legal institutions in which personal rights are most effectively protected, is an important problem in almost all legal systems. For this reason, the solution of the problems related to the nature and determination of non-pecuniary damages will be possible with a research supported by different perspectives. For this purpose, the handling of the institution of non-pecuniary damages in Turkish and American Laws and the problems encountered in practice have been examined in this study. First of all, the place of the institution of non-pecuniary damages in these two different legal systems has been discussed separately. Likewise, the approach of these legal systems to the concept of non-pecuniary damages has been determined and thus the purpose and function of the institution of non-pecuniary damages has been explained. Finally, the comparative law method has been applied and the similarities and differences in Turkish and American Laws have been examined in the context of the types of non-pecuniary damages.
