Abstract (EN)
Interconnection agreement is executed by and between electronic communication operators and is subject to the private law regime. Although it is a private law agreement, interconnection agreement also holds public importance as it relates to the freedom of communication of final users, and therefore it is also subject to the regulations of Information and Communication Technologies Authority where required by electronic communication sector regulations. This mere fact differentiates interconnection agreement from regular private law agreements. In this thesis, we examined the interconnection agreements by primarily examining the electronic communication sector in the first chapter and by examining the concept of interconnection and the interconnection agreement in the second chapter. In the second chapter, we approached to interconnection as a type of access and compared it to other types of access, then we assessed the components of the interconnection agreement and tried to point out the provisions that are applicable to the sui generic interconnection agreement. In the third chapter, we examined the whole process from execution to termination of the interconnection agreement.
