Mediation and the basic principles of mediation

Mediation is an alternative dispute resolution way, where the third party, independent and impartial, brings together the parties and they produce the most appropriate solutions to the dispute between the parties. The mediation method in Turkish law has been regulated by the Law on Mediation in Civil Disputes no. 6325 in order to resolve private law disputes. The high workload of the courts, the increase in the population, the continuous improvement of the business areas in modern life, the advancement of technology and the judicial activities of the courts prevent the rapid and costless dispensing of justice. International regulations, Law No. 6325 and the Regulation on the implementation of this Law have defined mediation, defined the basic principles, field of activity, education, responsibilities and powers of mediation. In our study, the concept of mediation, international and national regulations regarding mediation, the historical development of mediation, mediation practices in comparative law and the basic principles of mediation will be examined in detail.
