Comparative analysis of the mediation practice between Turkey and England

The mediation, which is one of the alternative dispute resolution methods, aiming to eliminate the dispute without going through the trial, which can be expressed as the classical solution method of disputes, continues to increase its field of application. Unique structure of societies makes it necessary to have different perspectives in the mediation. In this study we examined how the mediation practice was shaped in two different cultures, in England and in Turkey. In order to limit the scope of this study, we examined England instead of the United Kingdom. Due to the similarity of the practice, it is possible to say that the study also covers Wales. In this context, this study is starting from the history and a sequence towards the current practice along with the court decisions was followed and detailed comparison is given in the last section. As a result of this study, England and Turkey practise reflects the characteristics of its legal system and has concluded that they are quite similar from the perspective of mediation's basic idea.
