Abstract (EN)

The impact of the termination of the construction contract for land share to third parties was examined within the scope and limits of the master's thesis. General information about the definition, elements, legal status, arrangement forms, form, provisions and termination of the construction contract in exchange for the share of land for the presentation of the subject has been given. The manner in which third parties qualify from the construction contract in exchange for the land share, the personal right arising from the construction contract in exchange for the land share, the contract of transfer of multiple receivables related to the same property, or the subject of the promise of sale and in the event that the construction contract for land share ends outside of performance, the legal status of the third party is examined, the problems faced by third parties, the opinions in the doctrine and the application of the Supreme Court's appeals are resolved tried to reconcile it. Within the framework of the consumer concept, the possibility of applying the provisions of the Law on Consumer Protection to the construction contract in exchange for land share and its effect on the legal status of third parties have been evaluated. Finally, an evaluation was made regarding the conclusion reached on the thesis subject. Key Words: Land Share Provision, Construction Contract, Effects On Third Parties, Termination Of Contract.
