Freedom of the internet in Turkish Law in the Light of the Jurisprudence of the European Court of Human Rights

Abstract (EN)

Within this research, "freedom of the internet" which is an inherent right to freedom of expression, has been discussed in the context of European Convention on Human Rights ("Convention") and Turkish law. In the first section of study consisting of three sections, public sphere issue emerged with the concepts of internet and freedom of expression has been discussed. Within the scope of supranational human rights documents, the regulations on freedom of expression and internet has been examined, the national regulations and practices on freedom of the internet has been included. In the second part of the study; articles of the Convention relating to freedom of expression and the case law of the European Court of Human Rights (ECHR), which embodies the provisions of these articles, has been examined in terms of internet and freedom of expression and restriction regime. Lastly in the third section; regulations and issues that arise with forms of intervention for freedom of the internet in Turkey has been evaluated by using the ideas that are introduces in the first two sections. In Turkey, both in terms of legislation and approach to the internet that conflict with the ECHR jurisprudence, has been demonstrated that interventions exceeded the margin of appreciation.
