Abstract (EN)
This dissertation, titled as "Justification of Non-discrimination From the Perspective of Legal Philosophy" consists of three sections. In the first section, firstly, the principle of equality is explained considering that the prohibition of discrimination is a requirement of equality. Then, the concepts of prejudice and discrimination are discussed. The second section is devoted to the philosophical view of the prohibition of discrimination. In this section, opinions that explain the wrongness of discrimination morally are discussed. These theories are; the view of disrespect based on misestimation of the moral worth of discriminatee, the view of disrespect based on not treating people as individuals and the view of disrespect based on demeaning meaning. Also it is discussed that discrimination is a value problem and disrespect for human dignity. Lastly, in the scope of the third section, the general framework of the prohibition of discrimination in legal documents is illustrated and the scope of the prohibition of discrimination in terms of the protected person and subject is investigated.
