Abstract (EN)

Fiqh, which is a part of Islamic law, has witnessed a rich literature thanks to its dynamic structure since its formation. This literature, which developed over time, brought along different types of writing in terms of both technique and content. The science of qawa'id al-fiqhiyya, which emerged as a result of the interpretation of the fiqhī acquis from different perspectives, is one of these disciplines. The universal rules have an important place in terms of showing the essence and principled aspect of fiqh. In this respect, various works have been written in order to gather the universal rules together and to bring a common explanation to the different rules. In this study, al-Zarkashī's al-Mantūr fi'l-qawā'id fürū fiqh al-Shāfi'īyya, which has an important place in the science of qawā'id, is analysed. In this framework, after presenting brief information about the life of al-Zarkashī, who is known for his multifaceted personality in terms of scholarship, the science of qawa'id and its historical development are briefly discussed due to its close connection with our subject. In the first chapter, al-Zarkashī's work, which constitutes the centre of our study, is analysed in terms of content and method, and its importance, its impact on later periods and its prominent features are determined. Subsequently, in order to determine the similarities and differences between them, a comparison was made with some works written in the kavāid genre. In the second part, the sources, terms and names used by the author in the work we have analysed are determined.
