Relations between collective debtors

In a relation of obligation, there may be one or several debtors. When there are more than one debtors, it is the case of a collective debt. The collective debt is classified in several sub-types. The applicable rules to each different type shall be distinct. These sub-types are grouped in two: the perfect collective debt and imperfect collective debt. In the first group, there are communal debt, partial debt, joint and several debt, cumulative assumption of debt and indivisible debt. In the second group, there are cumulative debt, and the debts formed via intermediary of contracts of guarantee, independent indemnity and insurance.The thesis aims to examine the relation between the debtors in each of these different sub-types. The said relations are divided into two phases. The first phase pertaining to the relations before the satisfaction of the creditor comprises the impact of the individual conduct of the debtors to each other. The second phase with regard the relations after the satisfaction of the creditor comprises the use of the rights of recourse.
