Abstract (EN)
Decentralized autonomous organizations, or DAOs, are a new organizational structure that has emerged with the development of technology and the spread of the blockchain system. DAOs operate with smart contracts coded on the blockchain system. People usually participate in DAOs by purchasing a specially created token. DAOs, which do not have a centralized management, determine their decisions with the votes of the participants in the system. The legal qualification of DAOs, which are quite different from traditional organizational structures, is currently unclear. In this study, the nature of this organizational structure, which is increasing day by day, in Turkish law and comparative law is tried to be revealed. In addition, this study analyzes the provisions of the general partnership in comparison with the structure and functioning of DAOs. This is because in the Turkish doctrine, DAOs are mostly characterized as general partnerships. On the other hand, in the analysis made in terms of comparative law, after a general explanation, the special legal regulations regarding DAOs are discussed in detail.
