Abstract (EN)
The defence of non-performance of obligation regulated in TOC art. 97 is counter-right which provides defendant to withhold his own performance until the claimant had duly performed or offered to perform his obligation. In our thesis, we research the historical development, objectives, legal nature, requirements, scope of application, effects and consequences of the defence. In framework of thesis, emerging problems related to the defence in Turkish Civil Law is tried to be solved through development of defence in German and Swiss Law System and views related to the defence in these law system
